The terms and conditions governing your use of this website and the tree care services provided by Prime Tree Care Service.
These Terms of Service ("Terms") govern your access to and use of the Prime Tree Care Service website, and the tree care services provided by Prime Tree Care Service ("Prime Tree Care," "we," "us," or "our"). By using this website, submitting an estimate request, or engaging us for services, you agree to be bound by these Terms. If you do not agree, please do not use this website or our services.
By accessing this website, requesting an estimate, or engaging Prime Tree Care for any service, you confirm that you have the legal authority to do so — either as the property owner or as an authorized representative of the property owner — and that you agree to these Terms in full.
Prime Tree Care provides residential and commercial tree care services across Chicago, IL and the surrounding Cook County area, including but not limited to tree removal, tree trimming and pruning, stump grinding, emergency tree service, tree cabling and bracing, tree health and disease treatment, land and lot clearing, and commercial tree care. Specific service details, scope, and pricing are confirmed in writing at the time of your estimate and are not guaranteed by general descriptions on this website.
Estimates provided through our website, by phone, or in person are based on the information and site conditions available at the time of the estimate. Final pricing may be adjusted if actual site conditions differ materially from what was assessed — for example, hidden obstacles, inaccurate property information, or scope changes requested by the client. Written estimates are typically valid for a limited period, which will be noted on the estimate itself. A free estimate does not constitute a binding contract until both parties agree to a scope of work and price.
Scheduled appointments and job dates are subject to weather, safety conditions, equipment availability, and emergency prioritization (for example, active storm response may delay non-emergency work). We will make reasonable efforts to notify you of any delays. Cancellation policies, including any applicable fees for late cancellation of a confirmed job, will be communicated at the time of scheduling.
You agree to provide our crew with reasonably safe and unobstructed access to the work area, and to disclose known hazards on the property (such as underground utility lines, septic systems, unmarked buried objects, or structural concerns) prior to the start of work. Prime Tree Care is not responsible for damage to unmarked or undisclosed underground utilities, irrigation systems, or other hidden hazards that a reasonable pre-work inspection would not have identified.
Certain tree work in the City of Chicago and surrounding municipalities — particularly work involving parkway (city-owned) trees — may require permits or approval from the applicable local authority, such as the Chicago Bureau of Forestry. Where permits are required, we will advise you accordingly; however, it remains the property owner's responsibility to confirm and, where applicable, obtain any permits required for private-property work unless we have expressly agreed in writing to handle permitting as part of the scope of service.
Payment terms, including deposit requirements, accepted payment methods, and due dates, will be specified in your written estimate or invoice. Late payment may be subject to additional fees as disclosed at the time of service. Work may be paused or delayed for outstanding balances on prior services, at our discretion.
We perform all work using industry-standard arboricultural practices. However, tree care inherently involves biological and environmental variables outside our control — including a tree's pre-existing health, root structure, soil conditions, and future weather events. We do not guarantee the survival, health outcome, or future structural performance of any tree following treatment, pruning, cabling, or other non-removal service. Any specific warranty on workmanship or materials (such as a planted tree) will be stated explicitly in writing at the time of service.
To the fullest extent permitted by law, Prime Tree Care Service's total liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability for damage directly caused by our crew's negligence during active performance of contracted work, which remains covered under our general liability insurance.
Note: Prime Tree Care maintains general liability and workers' compensation insurance. Certificates of insurance are available upon request prior to the start of any job.
